Terms & Conditions
Story Shades By Sam - These Terms & Conditions govern all services provided by the Studio to the Client. By confirming a booking, the Client acknowledges and agrees to the following terms.
1. Booking & Confirmation
A booking is confirmed only upon receipt of the agreed advance payment and acceptance of these Terms & Conditions. The advance amount secures the selected date exclusively for the Client and is non-refundable under normal circumstances. The remaining balance must be paid as per the mutually agreed payment schedule before final deliverables are shared.
2. Payment Terms
The Client agrees to make payments in accordance with the finalized quotation or selected package. Timely payments help ensure uninterrupted services and timely delivery. In case of delayed payment, the Studio may pause services or adjust delivery timelines until dues are cleared in full.
3. Coverage & Timings
Coverage will be provided as per the finalized schedule and locations mutually agreed before the event. While every effort is made to align with event timelines, major delays or last-minute changes may affect planned coverage. Additional coverage beyond scheduled duration is subject to overtime charges.
4. Client Responsibilities
The Client is responsible for timely coordination, permissions, and access to venues and locations. The Studio is not responsible for missed moments or incomplete coverage due to delays, restricted access, permission limitations, or circumstances beyond reasonable control.
5. Creative Direction & Editing
Artistic decisions including style, editing, color grading, shot selection, and delivery format remain at the sole discretion of the Studio. This ensures consistency with the Studio's professional standards and signature creative approach. Specific requests may be considered, but final outcomes follow the Studio style.
6. Delivery Timeline
The Studio aims to deliver final photographs and videos within the estimated timeline communicated to the Client. Timelines may vary based on project complexity, seasonal workload, client response time for selections, and unforeseen circumstances.
7. Cancellation & Rescheduling
In case of cancellation by the Client, the advance payment is retained as a booking fee. Rescheduling requests may be accommodated subject to date availability and mutual agreement. If the Studio is unable to provide services due to unforeseen circumstances, reasonable alternative arrangements will be offered where possible.
8. Data Storage & Backup
The Studio maintains backup copies of raw and edited files for a limited period after delivery. Clients are advised to download and securely store their deliverables promptly. The Studio is not responsible for data loss beyond the designated backup period.
9. Usage Rights & Promotion
The Studio retains the right to use assignment photographs and videos for portfolio, marketing, website, social media, and promotional use unless otherwise agreed in writing. Client privacy is respected, and sensitive content is not used without consent.
10. Equipment & Technical Failure
In rare cases of equipment malfunction, data corruption, or technical failure beyond reasonable control, the Studio will make reasonable efforts to recover content or provide alternative solutions. Liability is limited to the amount paid for the affected services.
11. Force Majeure
The Studio is not liable for delays, interruptions, or inability to perform due to events beyond reasonable control, including natural disasters, government restrictions, venue limitations, accidents, medical emergencies, or technical failures. Reasonable efforts will be made to reschedule or adjust services.
12. Delivery & Final Approval
Final deliverables are shared digitally through the designated delivery platform. Once files are delivered and approved, the project is considered complete. Additional revisions beyond agreed scope may involve extra charges.
13. Acceptance of Terms
By confirming the booking and making payment, the Client confirms they have read, understood, and accepted these Terms & Conditions in full.
